How much compensation can I get for pain and suffering in Queensland?
Under Queensland law, pain and suffering (also known as general damages) is assessed using the Injury Scale Value system. Based on the type and severity of your injury, you may be entitled to compensation ranging from a few thousand dollars to several hundred thousand dollars. What is Pain and Suffering Compensation?
Pain and suffering compensation refers to damages for the physical pain, emotional distress, and impact on quality of life caused by an injury. In Queensland, this is calculated using a legal framework set out in the:
- Civil Liability Regulation 2014 (Qld); or
- Workers’ Compensation and Rehabilitation Regulation 2014 (Qld), which assigns an Injury Scale Value (ISV) to your injury.
What category applies to my injury?
Most personal injuries fall best within one (1) category of injury under the Regulations. If you have multiple injuries, your injuries may fall within multiple categories. Each category of injury under the Regulations, contains a description of the injury.
For example, a “Moderate Cervical Spine – Soft Tissue Injury”, is described as follows:
“The injury will cause moderate permanent impairment, for which there is objective evidence, of the cervical spine.”
Understanding the ISV System
The ISV is a number between 0 and 100 assigned which is based on:
- The claim type
- The injury type
- The severity of the injury
- Whether there are multiple injuries
